We are committed to protecting your privacy 

We understand that you are concerned about the privacy, confidentiality and security of their personal information.  Australian Traveller Pty Ltd ACN 113 975 438 (we, us or our) is bound by the Privacy Act 1988 (Cth) (as amended from time to time, the Act) and the Australian Privacy Principles (APPs).  If you are from the European Union, the Company processes information in accordance with the General Data Protection Regulation. 

You consent to us collecting, holding, using and disclosing your personal information in accordance with this policy.  If you are under the age of 18, your parent or guardian provide their consent on your behalf. 

What information do we collect from you? 

Any personal information we collect is solely for professional and administrative purposes. The Act defines “Personal Information” to mean “any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not”. 

Personal Information we collect may include your name, email, shipping and billing address, payment details, company name, phone number, your history of purchases and use of our products of services and details of enquiries or complaints that you make.  Personal Information can also include information about any transactions, both free and paid, that you enter into on the website. 

We may also collect information about how you access, use and interact with our website. We do this by using a range of tools such as Google Analytics and Adobe Analytics. This information may include: 

– information about the location from which you have come to the site and pages you have visited; and 

– technical data which may include IP address, types of devices you are using to access the website, device attributes, browser type, language and operation system. 

We may also use third-party tracking technologies, such as pixels and tags, to collect data about your visits to our website and your interactions with third-party websites. This allows us to analyse traffic sources and user behaviour, and to serve tailored content and advertisements to you on external platforms. While this data is typically collected in aggregated or de-identified form, it may include information that is reasonably capable of identifying you.  

We also use cookies on our website. A cookie is a small text file that the website may place on your device to store information. We may use persistent cookies (which remain on your computer even after you close your browser) to store information that may speed up your use of our website for any of your future visits to the website. We may also use third party cookies or session cookies (which no longer remain after you end your browsing session) to help manage the display and presentation of information on the website.

How do we hold personal information?     

The personal information that you provide to us may be held in a number of different formats including software programs (located both onsite and offsite, including in the cloud), databases, filing systems and offsite backup storage. Personal information held by the Company may be stored in email accounts that are accessible through mobile devices. 

We employ strict security and staff training procedures to protect your personal information from loss, misuse, and unauthorised access, modification or disclosure. However, we cannot ensure the security of any information that you transmit to us over the internet and you do so at your own risk. 

We will also take reasonable steps to destroy or de-identify personal information once we no longer require it for the purposes for which it was collected or for any secondary purpose permitted under the APPs.  

Purpose of collecting personal information 

We use this information to: 

– provide our users with products and services and manage our relationship with you, including in relation to our subscription service, competitions, authentication and payments. We also use this information to improve our products and services.   

– customise and improve our users’ experience when users visit our website by presenting our users with goods and services that are more likely to be of interest to them;  

– contact you, for example, to respond to your queries or complaints, or if we need to tell you something important;  

– comply with our legal obligations and assist government and law enforcement agencies or regulators; and 

– for the purposes otherwise set out in this policy. 

If you do not provide us with your personal information, we may not be able to provide you with our services, communicate with you or respond to your enquiries. 

When do we collect this information? 

We collect this information whenever you interact with us including without limitation, when you use or access our website (including without limitation, interact with our chatbot), call us or email or communicate with us, or place an order for goods or services.  It is also collected when you join our mailing list, subscribe to our magazines (including both our print and digital magazines), subscribe to our newsletters or enter into promotions or competitions. 

Additionally, we may partner with third parties who provide us information about our users, for example, to help us screen out merchants associated with fraud.  We note, however, that information provided to those third parties by you is governed by any privacy policy provided by the third party and not by the Company. 

Third party distribution 

We may transfer or disclose your personal information to our related companies. 

We may disclose personal information to external service providers so that they may perform services for us or on our behalf. 

We may also disclose your personal information to others where: 

– we are required or authorised by law to do so; 

– you may have expressly consented to the disclosure or the consent may be reasonably inferred from the circumstances; or 

– we are otherwise permitted to disclose the information under the Act. 

If the ownership or control of all or part of our business changes, we may transfer your personal information to the new owner. 

We will take reasonable steps to manage and protect your personal information and ensure that any personal information disclosed to a third party is protected by that party in accordance with the Act. 

We may also use some of the personal information to obtain insights into the needs and interests of our users.  These insights may be shared with third parties but personal information provided to the Company will be de-identified. 

Overseas disclosure and storage of personal information 

We do not directly disclose your personal information to overseas recipients in the ordinary course of business.  

However, some of the personal information we collect may be stored or processed by third-party service providers located outside of Australia. For example, our website is hosted on servers located in the United States, and we use services such as Google Analytics, Adobe Analytics and a US-based email provider, which may involve the storage or processing of personal information on servers outside Australia. In addition, certain financial transactions may be processed through a third-party payment service provider located in New Zealand.

We take reasonable steps to ensure that any third-party service providers we engage operate in accordance with the APPs or comparable privacy obligations. By using our website or providing your personal information to us, you consent to the storage and processing of your personal information outside Australia as described in this policy. 

Personal Information and marketing 

We will use your personal information to offer you products and services we believe may interest you, but we will not do so if you tell us not to. These products and services may be offered by us, our business partners or other service providers. 

Where you receive electronic marketing communications from us, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication. 

You can opt out of targeted advertising by adjusting settings in Google Ads (located at https://www.google.com/settings/ads) or visiting the Network Advertising Initiative opt-out page (located at https://www.networkadvertising.org/choices/). 

Access to personal information 

You may access or request correction of the personal information that we hold about you by contacting us. Our contact details are set out below. There are some circumstances in which we are not required to give you access to your personal information. 

There is no charge for requesting access to your personal information, but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent on collating large amounts of material). 

We will respond to your requests to access or correct personal information in a reasonable time and will take all reasonable steps to ensure that the personal information we hold about you remains accurate, up to date, complete, relevant and not misleading. 

Your rights under the EU GDPR  

Under the European Union (EU) General Data Protection Regulation (GDPR), as a data subject you have the right to:  

– access your data; 

– have your data deleted or corrected where it is inaccurate; 

– object to your data being processed and to restrict processing; 

– withdraw consent to having your data processed; 

– have your data provided in a standard format so that it can be transferred elsewhere; and 

– not be subject to a decision based solely on automated processing, 

(together, the Data Subject Rights). 

We have processes in place to deal with Data Subject Rights requests. Our actions and responsibilities will depend on whether we are the controller or processer of the personal data at issue. Depending on our role as either a controller or processor, the process for enabling Data Subject Rights may differ, and are always subject to applicable law. Compliance with Our Privacy Policy 

We use the information we collect only in compliance with this Privacy Policy and applicable privacy legislation. 

Customers who use our services are obligated through our agreements with them to comply with this Privacy Policy.   

Notifiable Breaches 

The Act requires us to notify the relevant parties if there is an eligible data breach. This means we will let you know in the way we normally communicate with you, if: 

– there is unauthorised access to or disclosure of your information; or your information is lost and unauthorised access or disclosure is likely to occur; and 

– there is a reasonable chance that this could cause you serious harm (which can include physical, physiological, emotional, economic or reputational harm); and 

– we have been unable to remedy the situation in line with the Act. 

If we are unable to contact any affected parties individually we will post a notification that an eligible data breach has occurred on our website.   

In the event of an eligible data breach, we are also required to inform the Office of the Australian Information Commissioner.  We will follow our Notifiable Data Breach Procedure in these instances. 

Changes to our Privacy Policy 

From time to time, we may change our policy on how we handle personal information or the types of personal information which we hold. Any changes to our policy will be published on our website.

Complaints 

If you have a complaint about the way in which we have handled any privacy issue, including your request for access or correction of your personal information, you should contact us. Our contact details are set out below.  

We will consider your complaint and determine whether it requires further investigation. We will notify you of the outcome of this investigation and any subsequent internal investigation. 

If you remain unsatisfied with the way in which we have handled a privacy issue, you may approach an independent advisor or contact the Office of the Australian Information Commissioner (OAIC) (www.oaic.gov.au) for guidance on alternative courses of action which may be available.
